Towing Issues: warning before towing, small claims court, condo association

My condo ass'n. posted that security will be at the gate during hours of 6pm to 6am. The rules and regulations require a guest pass for visitors after 1am. I was unable to find the security for several hours before and at the time we left our property to go out for the evening. We returned around 4:30am. My friends car had been towed. The warning sticker was placed on the vehicle at the same time it was towed. The security called them and we paid the company 100.00 cash for bringiong the car back. Because this is not really a wrning and it is posted that secvurity is at the gate I requested a refund. The board of directors have not responded in over a month. This is actually the 2nd time this happened. Our "condo laws" allow visitors and we have no designated spaces (open parking). At the meeting when I requested a refund the securrity stated they did not even have passes to give anyway. Can I take this matter to small claims court? Do you think I have a case?

Well it sounds like the condo association is trying to make things right, but there are more issues that need to be done.
They did give a warning, they have security (who might have to make rounds to make sure that the property and all in it is safe), they say they are going to have permits... Sounds like they are really trying..

As to taking it to Small Claims Court, sure you can do that, but remember you have been paid back and it might seem that you are really out for vengeance..  That could backfire on you if you are not careful..
