Towing Issues: WORKING WITH AAA/CERTIFICATION WITH A FELONY, tow truck drivers, rape murders

Question
I HAVE WORKED FOR MY PRESENT COMPANY FOR GOING ONTO CLOSE TO A YEAR NOW. DURING THIS TIME THERE HAS BEEN A NEW OWNER COME IN AND TAKE OVER AND HAS NO KNOWLEDGE OF THE TOWING INDUSTRY AND AAA SERVICE CALLS. I HAD BEEN WORKING SEVERAL MONTHS WHEN MY BOSS SIGNED ME UP FOR CERTIFICATION CLASS IN WHICH I DID ATTEND AND WAS CERTIFIED. NOW THAT THESE NEW OWNERS HAVE TAKEN OVER THEY LOST OUR AAA CONTRACT FOR ABOUT A MONTH. WE GOT IT BACK BUT ONLY IF WE HAD TO START ALL OVER IN THE WORST AREA AND TRY TO PROVE OURSELVES ALL OVER AGAIN, NOT A PROBLEM FOR ME. THE PROBLEM IS THAT NOW THEY ARE SAYING THAT THEY HAVE TO RUN BACKGROUND CHECKS ON EVERYONE WHICH IS REQUIRED BY AAA AND NOW ONCE THEY DO, NOT ONLY I, BUT AT LEAST 4 OF THE 6 DRIVERS HAVE FELONIES AND IN WHICH CASE WOULD HAVE TO BE TERMINATED. IS THIS FAIR BEING THAT I WAS HIRE AND CERTIFIED THROUGH AAA AND BEEN WORKING 6 DAYS A WEEK 12 HOURS A DAY+ FOR THEM TO BE ABLE TO LEGALLY JUST FIRE ME? IS THERE ANYTHING I CAN DO TO PROTECT MYSELF?

Answer
First of all, as a common courtesy,  any ALL CAPS message is considered yelling.

OK, now on to the problem.
Yes, AAA among other motor clubs and road service providers is starting to run background checks on contractor employees (Tow truck and service truck drivers). This is becoming a national trend.

From what I hear its in concern for the members safety.  And since they always seem to look out for the members at the cost of service provider service its not always good.

Now I know that different states also have background checks on tow truck drivers for doing police work. California is the first one that comes to mind.

Is it legal, as far as I know its legal and the kind of felonies which would prevent employment is not real broad.
I know that in most cases, auto theft issues, rape, murders and things like that would exempt you from the job.

But a general broad " any felony" ban might be to general to be enforceable... Best answer is to really check the requirements and get specific information. Then check with the local Unemployment / or Workers Employment office where you live. They usually have some people that can answer your questions about what is legal or not..
BUT keep in mind that this area of concern is new in some places. You might have to talk to a lawyer and see what they say.

If you want to talk further on this, you can reply here with private messages or e-mail me about it..  Flatman57@aol.com  and make sure to make the subject line " allexperts follow up " so that it gets though the spam filters.
I would like to know more as to what State you are in so I can research it more also.
