Trucking: Company wont pay Driver, state labor board, gretna nebraska

Morning,
My  brother worked for R&M Enterprises based in Gretna Nebraska, He was picked up in California back in 2002 for suspected DUI. He was cleared of the DUI  ( His truck was parked and he was off duty, they arested him for being under the influence) The Company fired him, on the spot,they never new all the facts. they owe him for 3 turns,about $2700.00. on top of that they went back to his direct deposit they made a day before and took that back too. I talked to the Company Rep, he said sue them.. now they put on a DAC report?? He was DUI  Driving their truck??? It was parked. Should I go after them .. and in what direction should I file a complaint?
I one day from calling the Federal Motor Carrier Compliance Division. Any other ideas?

Hello Charles,
You should have your brother call the State Labor Board. They can get his money for him. If he earned the money, the company can not keep from paying him.
I do not believe the FMCA can help on this. They are concerned about Safety of the trucking company operation.
