Auto Insurance Claims: Auto Claim Settlement, claims advice, claim help

My daughter was hit in the rear in Mar 2007 (she was 17 at the time) and the problem she has with her neck & back cannot be repaired. The doctors say it can't be corrected with surgery and that it will be with her all of her life. She has had several of these (it's like a balloon that is attached to the muscle) and physical therapy helps but only for a short while. The insurance company is due to make a settlement offer this week as the four year time limit runs out next week. What are my options and what should the insurance pay for in the settlement?

What you are asking me is really a legal question. And as to your options, if the 4 year time limit runs out next week, you are at the mercy of the insurance company.  Of course, that does depend on the laws in your state, but I am going to assume you no longer have the time to file a lawsuit.  Having said that, I can only wonder what has been going on for the last 4 years, and why it would take so long for the insurance company to make an offer.

I cannot answer what they should pay.  That is a complex decision based on her individual health issues and the coverage available.  What I can say is that you must be extremely careful not to take the first offer.  Just because the statute to file a suit has run (if that is the law where you are) does not mean you have to settle within that time ... especially if it has been the insurance company that has been dragging its feet.
