Auto Insurance Claims: Friend involved in accident on my motorcycle, Friend involved in accident on my motorcycle

Question
The other week my friend was involved in an accident on my
motorcycle in which a car pulled in front of him in an
intersection; he went into the side of the car and suffered
several broken bones in his skull and glass in his left eye
which he won't be able to see from again.  The driver and
passenger of the car parked the vehicle and ran from the
scene.  We later discover the car was "stolen" but the
police reports have not come out yet to verify the time of
the theft.

I was planning to sell the motorcycle to this friend of mine
who was trying to acquire the money to pay me for it.  It
has no insurance and was unregistered; however, he would use
an old plate of mine and fix it to the back of the
motorcycle to "appear" legal (I never gave permission for
this).  Most of the time he would come to my place and take
the bike without my permission or me knowing.  I told him
several times to just sign the title in case of an accident
and worry about payment later, get the bike registered and
get insurance but he did none of this.

As of now, he has an attorney who is working on the case and
the car's insurance denies fault at the moment.  The
attorney wants me to sign a form saying I had no insurance
on the motorcycle and would like to store it in their
warehouse for evidence.

I was also involved in a similar accident 2 years ago with
injuries but had insurance and filed a claim to cover
medical expenses and such, which the attorney was asking me
about. I answered the questions lightly and did not want to
tell much about my accident.

I guess my question is where do I stand in this situation
and what I should do, expect, etc.?  Should I sign certain
forms and allow them to store my motorcycle?  I'm still good
friends with the injured driver and visit him and his family
frequently to check up on him but this situation is making
me a little paranoid.  I'm just afraid of this situation
getting out of hand and the finger becomes pointed at me,
which is understandable since it was my vehicle.  But there
are a lot of loose-ends that seem to complicate it all.

Thanks much for any help or advice you can give me.

Answer
Hello Adam,

This question is not about a claim, but rather if you should sign paperwork. You need a lawyer before you give statements, sign paper work, or agree to anything.

You do have a claim against him for crashing your motorcycle and this cannot simply be ignored.

Talk to a lawyer who can instruct you better. It would be legal advice to tell you either way.

Good Luck,
Anne
