Auto Insurance Claims: former question, shoulder injury

Question
Thank you for answering my previous question. You said shoulder soft tissue injury usually warrants more pain and suffering damages than the $2000 I was offered.  Can you give me an idea of how much more?  I don't want to be too demanding, but I am living with shoulder pain, and according to my doctor, it may never go away, so I don't want to ask for too small of an amount either.  Thanks, Cherri

Answer
Cherri,

It is almost impossible for me to give an accurate settlement amount just based on the information you have provided, but here's my best shot at giving you what you need. . .

Things that a shoulder affects:

1.  Brushing your hair
2.  Brushing your teeth
3.  Lifting your purse
4.  Turning your steering wheel
5.  Pulling the covers up over your head
6.  Playing any sport
7.  Swimming
8.  Using a hammer and nails
9.  Putting on make-up
10. Carrying a small child
11. Carrying groceries
12. Reaching grocery items on the top shelf

I hope you get the idea. . . there are many things that can be affected by a shoulder injury.  If the injury is permanent (surgery won't help), then you will be doing all of the activities listed under duress which adds to you pain and suffering.  I would request at least $4500.00 for the injury, and then settle at no less than $3500.00.

This is not legal advice, just my opinion.
