Auto Insurance Claims: UIM Claim, insurance expert, claim settlement

Question
Hello there,
I got into an accident 2 yrs ago, and Now I'm dealing with Statefarm about my UIM Claim. I was injured badly. I got a broken ankle, fracture rib, and fracture risk. As for my ankle, my bone was broken and also misplaced, and there were many broken tiny bones that they have to put a plate and put screws in there to help me to be back on my feet. Now that I have taken the plate out, it doesn't make any differences at all. It still aches and I still get a little pain sometimes. I do have a scar and its a ugly one too. My 1st and 2nd party is done settling, I just now need to settle the 3rd party which is the UIM Claim. My total medical bills is 9,275.00. With all those bones that have to be screwed with a plate and the tenderness feeling and aching, how much should I ask for?

Answer
 Hello Nancy,

You have losses that exceed just your injuries.  There are two types of damages.  The dollar amount you are referring to are your economic or special damages. These are easy to calculate. They include such things as lost income, medical expenses and other direct costs.

The second type of damages are your non-economic damages, or general damages.  These are more difficult to calculate.  These types of damages come in the form of compensation for pain and suffering, or distress, or humiliation, etc.  Negotiating these types of damages, in my opinion, requires the services of a skilled personal injury attorney.  With injuries as serious as yours, you should not attempt to settle on your own - especially on a UM claim.

Good luck.  I wish you well.
