Auto Insurance Claims: financial responsibility for accident, clerks office, notory

My son is having a problem both insurance companies refusing to pay and is being sued by the other driver.  He was driving a vehicle titled to someone else.  When he tried to get the title transferred the clerks office told him it was not correctly filed out and gave him a form with the items to correct checked and the date.  The day of the accident my son got a ticket for not having proof of insurance of the van.  He had insurance on his own car but the van still was not titled to him.. He took the proof of insurance to court and the ticket was dismissed.  It was understood that the accident was being paid by the owner's policy. Unfortunately the owner was the step-father of his now ex-girlfined. Now two years later, he has produced a document notorized by his daughter that the  title was transfered prior to the accident but it is still it his name. This is also before the date on the paper from the clerk's office.  Then the ultimate is the insurance company now says the coverage was cancelled on the very day the accident happened. I think he is getting scammed. The insurance agent is a friend of his of twenty years.  For an entire year nothing was said and probably never would have except for the break-up.  Whay can we do?  Thanks

Unfortunately, there are too many unknowns here for me to properly assist you. All I can say is that you will need to get actually copies of each of these documents. You will need to get a copy of the policy cancellation document directly from the insurance company which will show the date and time of the cancellation. You will need a copy of the title showing the date of transfer and th notory stamp which will have the date it was notorized.

If it all checks out ther is not much you can do. It it appears that there is any funny business going on you will either need to hire an attorney or file a complaint with the state attorney for fraud.
