Auto Insurance Claims: Property Damage Claim, property damage coverage, uninsured motorist property damage

I represent plaintiff.  If the at-fault driver's property damage coverage is exhausted for repairs to my client's vehicle, does the plaintiff's own comp & collision start paying for their insured's (plaintiff's) property damage?

Hi Yvonne,

Yes. However, the claim should have been presented to the 1st party carrier as soon as the limits problem was known. If your client lives in a state that has uninsured motorist property damage coverage then it is that coverage that will pay.  If UM coverage is available your client may also be entitled to compensation for diminished value.
