Auto Insurance Claims: Total loss recovery, comparable vehicles, fault insurance

Hello, Richard,
My daughter was rear-ended with a result of total loss to her car.  The car was paid for.  The at-fault insurance company is allowing only a set amount in settlement for the vehicle (much less than a replacement, of course) stating that they have searched for "comparable vehicles" in our area.  We have found several vehicles within a 200 mile range with the same make, model, approx. mileage, etc.  They refuse to budge.  This is about a $2000 difference.  How can we make a better case?
They are also handling personal injury separately.  Medical bills, hospital bills, pain and suffering. Thank heavens, she wasn't injured severely, but she is now having to lose work/study wages because of her inability to get around.  The adjuster for the car loss says this will not be covered and the adjuster for the personal loss says this will be covered under loss of use, damages.  Who is right?  Or is this a "gray area" that WE lose out because the insurance company is being obstreperous?

You will need to hire a professional appraiser to appraise the value of your vehicle. Then you will have documentation to help you negotiate more effectively. In addition to the value of the car you will be entitled to either the cost of a rental car until they make you an offer or a loss of use payment which is generally areond $15.00 per day.  As far as the injury clsim and the other items you mentioned these will all be addressed as a single settlement amount to include pain & suffering, lost wages and any other expenses incured.
