Auto Insurance Claims: Auto Insurance Claims, auto insurance claims, lump sum settlement

I was involved in an accident. I have valid sr22 insurance at the time of my accident. The car I was driving belonged to my friend who was a passenger during my accident. My friends car hard no insurance though he claims he had one. I was hit from the back and the car is totaled. I have broken ribs and on pain medication and still seeing the doctor. Can I claim for bodily injury from my own sr22 insurance policy or claim from the guy who hit me. Do I file claims from both policies?

Hi Michael,

Generally, insurance follows the vehicle not the driver. This means that you would have no claim against your own policy unless in your state you have Personal Injury Protection (PIP). Otherwise you claim would go through the at-fault drivers insurance.

Keep in mind that they will not pay your medical bills as they are incurred. They will make a one time lump sum settlement with you when all of your treatment is done. This settlement should include payment of all of your medical bills, lost wages, pain & suffering and any other expenses you can show.

Considering the broken ribs it would be a good idea to consult with an attorney before agreeing to any settlement.
