Auto Insurance Claims: no damage to vehicle that hit me, washington state patrol, insurance comapny

My brand new little car was sideswiped by a giant motor home going North on I-5 on 6/3/07 when he partially passed me and then decided to change lanes into the side of my car.  I swerved off to the side of the road but he didn't stop.  I tried to write down his license but he didn't have a rear plate.  I pulled back on the freeway caught up with him honked and motioned for him to pull over.  He claimed if he had know he hit me he would have stopped and said of course he was insured.  I had no cell phone and we didn't call the police.  He said he just bought the motor home (used) and he had no damages.  The insurance adjuster took almost 2 weeks to come look at his motor home.  Because they could not find conclusive evidence his vehicle was in an accident they are not going to pay.  That motor home is built like a tank, my car had only minor damage but that's still $1000 I shouldn't have to pay.  I didn't have time to find witnesses because he drove off and I followed. I would have just called the police and reported it as a hit & run if he had a license plate.  I even called the Washington State Patrol after the accident to see if anybody reported it. They told me to still file a collision report now I am worried that might make my insurance go up eventhough I wasn't at fault?

HI Anne,

This is an unfortunate situation. His insurance company can take any position they wish. The only thing that can make them pay is a judge. You would have to file a small claims law suit against the motor home owner in the county where he lives. Present your case and if the judge feels you have proven your case you may win.

Aside from that, the only thing you can do is to file the claim with your own insurance company. Thay may then try to collect something back from his insurance comapny.
