Auto Insurance Claims: accident injuries, accident injuries

Question
My son who is 17 yrs. old was in an accident on 08/23/11. He was a backseat passenger in a one vehicle accident. The owners insurance company said the accident was only allowed up to a $50,000 per accident and $25,000 per person. The driver is 18 so he is not entitled to any of the payouts, however they were three minors involved in the accident. The insurance adjustor said they would have to look over all medical bills to determine how to split the $50,000 amongst the three minors. My son suffered a broken collar bone, two breaks in his lower jaw bone which resulted in surgery that included 4 metal bars and 4 metal rods being inserted in his lower jaw bone, he also had a nerve in his jaw bone that was severed into causing loss of feeling at the area, and was hospitalized for three days. He has had to have a root canal on one tooth that was broken half off and is having to have a permanent crown put on. I have filed an underinsured claim with my insurance company due to the high medical bills and was told i could get $25,000 from my own insurance policy, but the other insurance company is not as friendly and said it will be a long time before they could even call me with a settlement. I just want to know what i could do to hurry up the process and get it over with.

Answer
Hello,

I am very sorry to hear about this. There is nothing you can do to speed up the process as they will probably will not want to settle with you. The "driver" of the vehicle may not be entitled to $25,000 if the driver was at fault (regardless of age).

They will have to split the $50,000 among everyone and this will leave you with issues.
