Towing Issues: Legal Recourse for Damaged Property During a Tow, legal recourse, small claims court

Question
My car was recently towed by my neighbors who did not realize I was a new tenant in our building. When I went to pick up my car it sounded like a 1950's truck (my car is a 95 Honda accord) and it wouldn't accelerate. I had the car towed by my insurance company back to my residence then the following day I took it to an auto shop. The mechanic called me later that day and told me that my catalytic converter had been "cut" and "stolen" from my car. I talked to the tow company and they gave me the run around for about a week before they blatantly told me that they were not going to reimburse me for the damage to my car. I am definitely sure my car had a converter before it was towed.  Do I have legal recourse.

Also I am new immigrant to Ontario from the states, my car is registered in KY. If you don't have any answers for this question. If I could get pointed in the right direction to do some research that would be great too.

Any help would be greatly appreciated. Thank you

Answer
David,

A catalytic converter is worth something to a scrapper, but a tow company would have to be completely stupid to be doing things like this.

The only legal recourse would be small claims court. I would suggest calling the tow company again and letting them know that you are considering taking them to court. Maybe they would then have more information, or at least explain their point of view.
