Towing Issues: Improper towing, tow truck driver, small claims court

I live in Durham, North Carolina and this morning my car was towed. I live in an apt complex, and they are painting the asphalt. A notice was sent out last week telling us that painting would be taking place, and if cars were in the affected area they would be towed.The day my lot was painted I moved my car and all was fine. Last night when I came home all the lots for my side of the complex were full so I had to park in a different lot. That lot was due to get painted this morning and I had no knowledge of this or been notified. Do I have any grounds to make them reimburse me or to take legal action?

Well you knew that the lots where going to get painted, and you tried to follow the requirements it sounds like. But like any typical parking lot for apartments or condos they do not have enough spaces to park in to start with. Add in the maintenance issues and it becomes a nightmare..


From what I see here in the question, I really doubt you would have much of a chance of getting a refund at all (remember I am just a tow truck driver here who volunteers to answer questions) but you never know what talking to the tow company or the apartment management would do...

Small claims court is always an option but I really do think that would be a waste of time as notice was given and you did try to comply, but you never know what they  will rule on.
