Towing Issues: Towing Issues, tow yard, tow company

My story is below:
I paid for the parking, bu the ticket was only half printed by the machine.  I displayed the ticket still in my car.  After work, I found that my car was gone.  I went to the towing company and they said they don't have my car.  And then I go to ICBC and report the claim saing my car got stolen.  5 days later, police called me and told me my car was towed by the towing company because I didn't pay for the parking.  Now, I have to pay the ICBC for car rental, and also the towing fee and the fee that my car stay in the towing company.  

In this case, i want to know who should responsible for the fee?  I checked with the towing company right after I found my car gone.  And they checked it and said they don't have my car at that time.  Also, I paid for the parking already.  Please help.

well it sounds as if this happened in British Columbia (ICBC) and while the vehicle was "legally parked" the half printed receipt issue becomes a key here...

The parking facility holds some responsibility there as the machine malfunctioned.  Now who called for the tow, or was the tow company able to cruise the lot looking for violators is a key here.

Now when you went to the tow company right after it was towed, did they look out in the lot or was it a computer or paperwork check ?

There is the possibility that the vehicle might of been stolen at that point and they in truth did not have it, but it might of been towed at a later point, which would generate the police report for a recovered vehicle at the tow yard.  This could happen also...

As to the responsible party for the fee, well first of all insurance is supposed to cover the fees, but it sounds as if they believe it was just illegally parked instead of stolen and towed at a later date.

I think this is one where  you are going to have to work on proving it was at the tow company the whole time if it was a "TRUE STOLEN" vehicle.  But I do have to say at times the tow companies do make mistakes with paperwork and that might of been the case also.
