Towing Issues: MY CAR WAS TOWED, police check point, tow truck driver

Question
QUESTION: IS THERE A FEE CALLED DISENGAGEMENT FEE,AND UNDER WHAT GROUNDS SHOULD THIS FEE BE CHARGED. STATE OF MO

ANSWER: Disengagement fee = Drop fee = release at scene fee

All of these are common and unless there is a "specific law" in your "CITY" against it then it can be charged....

Again the charging of the fee, also depends on what has been done to tow the vehicle... In "most cases" a part of the tow truck has to be attached to the vehicle before it can be charged... In some areas it has to be in the air (lifted) and others it has to be ready to go down the road but not yet left the parking lot...

I hope this helps, but its kind of a general answer to a question which has no real answer in some places.

QUESTION: To explain my situation in full, My son was arrested at a police check point, here in st.louis MO. He called me before they got to him, told me what was going on I left work got there before my car was taken away. When I spoke to the officer in charge he said it was up to the tow truck driver, as to weather I could get the car at that point, he said no, I offered to pay and everything still my car was towed. It took me two weeks to get it back. My son was arrested because he told them a fake name, and no drivers license. Is disengagement or drop the law or a choice of the tow people.

Answer
well if the police had it towed and they required a release to be issued by them as a condition of release from the tow company then it would be out of the hands of the tow company...

Now as to the tow company, they do have various state laws along with specific requirements in the police contract.

But if the police were allowing the tow company to release the vehicle at the scene the its strange the tow driver did not want to do that at the location...

And what were the reasons for the 2 weeks to get the vehicle back, that is what I would like to know about.

Sorry to hear your son got arrested and I hope that is all straightened out.
