Towing Issues: towing and lein sale, gov pubs, dmv ca


Question
My car was towed from a gated community in Tustin, California on January 25th.
It's value is approx. $4000. Because of some personal issues, I was unable to
pay for the tow and impound fees until now. When I called the inpound yard and
asked for the cost to release my car, I was told the car has cleared lein and was
now the property of the towing company. Do I have any recourse?

Answer
California does have about 2 dozen laws regarding liens on vehicles. Some of them are based on things like Value of the vehicle, reason it was towed, or agency who ordered it towed...

But I am assuming that you did get some notifications that the vehicle was towed, and that you got letters (certified) of the pending sale of the vehicle...

Also I really hate to say it but you can also be facing collection agencies to recover any owed fees resulting from the sale of the vehicle verses the amount of sale of the vehicle..
