Towing Issues: car towed from apartment and not being able to recover, maryland mva, certified mail

I live in Annerundal county in maryland.  I had my car towed from my apartment 31 days ago for an expired tag (i had it the afternoon it got towed) and i didnt have the 300.00 i get the car so i waited till my income tax had come in and talked with the towing company every week.  I never recieved any paperwork on their intension with the car and when i had called nothing was ever told to me about 30 days.  I am willing to pay the towing fees and the impound fees.  Do i have any legal recourse expecially seeing i owe 900 in towing fee's but he said he sold the car for 3200 to a salvage company.  They do not have the title, or the registration!

Well, the "LIEN LAWS" for Maryland are hard for me to find, I tried for a while with the Maryland MVA website and a few others that I know of for this type if information so I will answer using "generic information"

First of all even though you knew it was towed, you knew the price was increasing daily.. But also that same knowledge of it being towed does not mean that the tow company does not have to notify you of a pending sale of the vehicle.

Generally you would receive a "certified letter" which is sent to the "last registered vehicle owners address" and those letters are generally not forwarded. Did you move since you tagged the vehicle?
That could be a problem also as you were attempted to be notified and if the letter was returned or you did not accept it, then the to company does proceed with the sale of the vehicle.  Now the proof is on the tow company to prove that you were either notified or were unable to be contacted "by certified mail" before they could sell the vehicle...

This is a key point and I wish I could find the info I had dealing with lien laws in each state, but sadly in the computer age, I had a melt down and lost most all of my linked pages..

Your legal recourse, well you always have the small claims court route, but I would check with the Maryland MVA and see what they say the laws are regarding lien sales of vehicles (if they give you a regulation number can you send it to me ??? Please that would help a lot for future answers).

The fact they did not have the title or registration is not a big deal with lien sales as they get a title from the state which overrides all the others...

By chance was your vehicle financed?  Reason I ask is that the legal owners (finance company or bank) might of received a letter from the tow company also.. That might be something as they tend to have lawyers just waiting to do something...
