Towing Issues: Illegal Towing?, wichita police department, private property owners

I live in Wichita, Ks. My landlord had my vehicle towed from the Apt. complex that I was living at, even though my rent was fully paid up for that month. Now the towing Co. wants $1200.00 for towing and storage. I did not request for the tow, do I have to pay to get my vehicle back? What are my rights and options?

well you have rights and the landlord has rights also...

Why was the vehicle towed is the big reason ???

Just because you did not want it towed does not mean you do not have to pay.  The tow company did respond and do the job requested by the property owner - manager or landlord, for what ever reason that they deemed it needed to be removed from the property..

The $ 1200.00 kind of tells me that this issue has been going on for a while and that they is some storage involved like maybe a month or so ago it was towed...

Private Property Auto Tows



The Wichita Police Department is no longer allowed to tow cars from private property and private businesses, unless it presents an environmental health issue.  On March 15, 2005, Section 11.52.020 (27)(b) and (c) of the City Code relating to Hold Harmless Agreements was repealed.

Property Owners and businesses that request vehicles to be towed should now refer to City Code Chapter 11.99, which sets out requirements for private property owners to tow vehicles.

Under City Ordinance 11.99.030, the property or business owner requesting the tow is required to contact the WPD Records Bureau within one hour of the vehicle being towed.  Failure to comply with this ordinance can result in a fine of up to $1000.  Private property or business owners are to contact the Records Bureau at 268-4186 and report:

Vehicle Year

Make and Model

VIN

Towing Company name and address

Where the vehicle is being towed

Person Ordering the Tow

Address from which the vehicle was towed
