Towing Issues: suspended license, tow company, licensed drivers

My boyfriend got a ticket for suspended license, they let him start my truck to wait for me to pick him up, but refused to let me drive my truck home.I did not know his license was suspended.Can police in Oregon do that?
I am entitled to legal posession of my truck impounded under ORS 809.720 or Ordinance # 2756 I can request a hearing to contest the validity of impoundment (within 5 days). Should I contest or am I out my impoundment fee?

Sorry for the delay in answering your question but have been real busy towing lately...

General procedures for vehicles which have a suspended licensed driver who was driving is that the vehicle is towed and held till the fees are paid and a licensed driver is able to drive it out of the yard.. In some Cities in Oregon you also have to go to the police department and get a written release before the tow company will begin to even let you get it back...

Now as to you not being able to drive it back home, I am not sure but I imagine you showed up in another vehicle by your self and they did not want one vehicle left on scene.. Usually they as for 2 licensed drivers to come get the vehicle and YES they do check the licenses before they let it leave.

Now I know that you can contest the tow reasons and if you feel that you were wronged you can do it. But it will most likely come down to you would of had to leave it or the other vehicle there and still have the risk, liability or hazard.   Even though the police do tow vehicles at times it is also to protect and prevent damage or vandalism to a vehicle left beside the roadway.

But you can never tell or know what the hearing will result in, you might win, you might lose. It is a 50 - 50 shot on it, and if you feel that you have a good chance to win then go for it... Its hard for me to tell you an answer as I was not there and do not know the whole issue.
