Auto Insurance Claims: I was hit by someone that ran a yeild to ramp sign, salvage value, own insurance

Question
QUESTION: I exited the freeway to turn right at the first street, I did not cross any white
lines. The other person ran through a yeild to ramp sign and hit me in the
passengers side of my car. His insurance is finding me 70% at fault. The car has
been totaled. Am I 30% at fault, and if I am and the car is totaled, if they pay me
70%, do they get to keep the car.

ANSWER: You didn't mention your own insurance and whether or not you filed a claim under your policy. I am assuming you don't have more than liability coverage on your own car and any proceeds from a claim would come from the other person's insurance. If their insurance finds you 70% at fault, then you will only recieve 30% of what the car was worth prior to the accident. If the car is totaled, upon acceptance of their settlement offer they get your car.

The only way you get to keep your car in the case of a total loss is to have them deduct the salvage value from the settlement, which is typically 20% of the car's value immediately before the loss. Depending on where you live, the car's title will be branded as a total loss, and you will have to apply for a title and have it inspected after it has been repaired.

QUESTION: Sorry for the type-O, I ment  to say they are finding me 30% at fault. But I guess
my real question is, if they ran a yield to ramp sign, why am I at fault at all?

Answer
That is a matter that will have to be settled in court. Any witnesses to the accident would be helpful to prove your case and eliminate any of the fault assigned to you. If the guy failed to yield to you and hit your car anyway, then you stand a good chance of reversing the 30% ruling.
