Auto Insurance Claims: New Lease - Vehicle accident, subaru outback, bearer of bad news

I leased a 2006 Subaru Outback XT 2 months ago.  A few days ago someone hit it while it was parked on a public street.  The damages are between 10k-12k.  The adjuster wants to repair the vehicle and i would rather it be replaced... is that an option?  The vehicle that hit my car was uninsured and my insurance is saying that they will not allow me to claim diminished value. What are my options?  Should i have a third party adjuster look at the vehicle?

Unfortuneatly your insurance company has the final say in whether the car is repairable or a total loss.  As a general rule your cars damage has to exceed 70% of the vehicles value to be a total loss.  As far as diminished value is concerned that is excluded in your policy.  It would not be excluded on the other guys policy if he had one but very hard to prove.  Having somebody else look at your car will not do you any good as the insurance company will only accept their estimate.  I hate to be the bearer of bad news but that is how insurance works.
