Auto Insurance Claims: how can the adjuster deny my claim when it was their clients fault, which is the truth

my son was rearended while waiting for traffic he was pulling out of a parking lot and the 17 year old kid behind him gassed it and totaled my car then told my son sorry i thought you were going to go, he just wasnt paying attention and then he left the scene, my son did the right thing and stayed there and waited for a police officer and the police officer wrote on his report what happened and their was no witnesses other than the other boys mom and my sons girlfriend, well ive been waiting on his insurance to fix my car and the boys dad has been calling my house and harassing me and saying he has a witness which is a lie and they told the insurance that my son backed up into him which is also a lie, i just got a letter from his insurance denying my claim, why would they deny me and just go on the word of their client and they didnt even talk to our witness when everything is stacked against him i mean he left the scene, can i sue the insurance company along with the client and why did they deny me?

Your question is common.  Let me give you some straight facts. . .

1.  The police officer cannot testify as to what happened unless he/she actually saw the accident occur.

2.  Whoever a jury believes will win.


  I'm sorry, there is just no winning in this type of situation.  If we can't get down to the bottom of what happened by piecing together the evidence, then the words of a couple of teenagers and questionable witnesses is going to have to be debated in front of a jury.  Either story could be true in my eyes.  How do you know which story is the truth?
