Towing Issues: Towing Reprecussions, second car, court actions

I live in Los Angeles and my apartment has a parking spots that is structured where we can park two cars (the second car is parked directly behind the first car--so one would have to move the second car if one wanted to move the first car out of the parking spot).  Unfortunately another tenant in the building often takes the second car parking spot--which (i) blocks exit of the first car and (ii) prevents us from parking our second car.  

What would be the possible reprecussions to me if I towed his car away the next time he parked in our spot? I've told him twice that the next time he parks his car in our spot, we will tow away his car.  There are no signs posted anywhere regarding parking or towing.  I just don't want to get sued somehow if I tow away his car.

First of all, the manager is the one that calls for tows of illegally parked cars.  Having tenants call is one heck of a nightmare. To many big problems there.

Now it sounds like your complex does need to address this issue. Talk to the manager and see what he can do.

Now as to reprecussions.  Well as the person who orders the tow, you would be responsible for proving it was a valid tow, and also subject to court actions if the person wanted to contest the tow.  

Its a no win here.    deal with the property management. They should have all the answers and be able to solve the problem
