Towing Issues: Towing Liability, whip lash, brake car

Dear Richard,
My Friends car needed to be towed from my driveway (she was not there).  The car had locked up, and would not shift from park.  I live on a hill.  She told the driver, who arrived in a flatbed, not to do anything.  He decided to put a jack on each of the back tires and told me to get in the car and step on the brake.  (car was in park, safety was on, and I had my foot on the break).  Again he did not have the owners permission to do anything.  He did something to the back of the car, and suddenly, the car rolled down the hill and hit the tow truck.  Two hours later, I was in minor injury with whip lash, and almost a month later I am still in pain.  They claim it is my fault as I was in the car (but the car is off and he has jacked up the back - where, I might add - the safety break is located (jaguar) - My question is - I would like to sue them for pain and suffering - are they right?  Thank you

I am sorry, but I am going to have to pass on this question..

 I do not want to get involved in any possible legal actions either as a " expert from here " or just a knowledgeable industry person..


I would suggest that you contact a lawyer and discuss the issue with them... They can answer more than I can..
