i was in accident the other ladies fault, i was hurt then and told insurance but couldnt go to the doctor right because i have a infant i care for fulltime and i was in so much pay i had to go to the emergency room 3weeks later ,the claim is not closed yet and i cant even be on the pain killers because i with my son all day and there say i waited to late but there other person didnt go right away either, should i just sue

Yes, I would see an attorney right away.  If they deny your claim for medical care three weeks post trauma, then that is unreasonable.  I am assuming that you had no intervening trauma, and that the doctor concluded that your injuries were the result of the accident.

You do have a good solid claim inasmuch as you did have an injury and you heroically tried to deal with it whilst tending to your baby.  No jury is going to punish you for that.  I have had successful claims where the client did not see a doctor for two months following an accident.

But it might take an attorney if the insurance company is going to be unreasonable.  Plus, your grammar will count against you if you try to do this yourself inasmuch as it leaves the adjuster to think that you are inattentive, and hence she cannot trust your recounting of history of the injury and pains, etc.

Thus, I would hire an attorney and let her take care of it.  I would not recommend that you try to resolve this yourself because your communication skills are so poor, as indicated by your writing here.  

Inattention to grammar also signals sloppy history keeping to the adjuster.  Thus, she will not trust your history of prior activities or your history of post accident problems since she will conclude from your writing that you are sloppy and do not give attention to the matters at hand.
