Nissan Repair: OIL LEFT OUT BY DEALERSHIP AFTER SERVICING, 2003 infiniti g35, infiniti g35

Question
Von, I work on the F-22 program.  Do you as well?

Anyway, this is a 2003 Infiniti G35 question.  After picking up the car from the dealership for 60,000 service, my wife noticed engine noise.  I checked it out - loud knocking.  Sure enough, the dealership had not added oil back in after draining it.

I had it towed back.  They claimed there was still a quart and a half in the oil pan.  They also claimed they had performed diagnostics, added oil back in, drove it, and it was fine.

I insisted on a new engine.  I'm a quality engineer, and I'm smart enough to know how much damage could have been incurred from the engine getting so hot.  They insist that, since it's fine right now, it's gonna be okay for the long run.

What's your opinion?  Do I need a new engine?  Should I sue?  Or can I accept their position at face value?

Thanks very much.

Answer
Scott,

I used to work on the F/A-22 out in Palmdale and I wish I was back on it.  Anyway, I am out in Las Vegas working for a Department of Energy contract running a laboratory.

If it were me I would go back to the dealer and raise hell.  First, with all of your records I would ask to speak to the manager of the dealership and the owner to boot.  If there was no resolution the next step is the zone representative.  Next you contact Infiniti corporate and raise hell.  And, if these people do not get you a new engine, for free, you go to the Better Business Bureau.  You should get a new engine out of this since they damaged your engine to where it would have to be rebuilt to be correct.  A quart and a half is not enough oil to keep the system operating and metal to metal contact occured so the rings scratched the cylinder walls and the rod and main bearings are worn.  Where are you at?  Palmdale, Ft. Worth or Marietta?  Email me back.
