Towing Issues: Towed and Auctioned in Alexandria, Virginia, us post office, alexandria virginia

I was out of town and my Benz coupe was towed from my condo. It had developed an "unsightly" flat tire and the condo association had it towed by a private company. While home for a couple of days, I received a towing co. letter stating my car was being stored and I had to pay in 30 days or action would be taken. The letter was sent 22 days after the car had been towed (State law says letters should be sent in 15 days). I attempted to contact them and left messages requesting the amount due. After going back out of town, I finally got through on the phone -- on the 30th day after my car had been towed. They informed me that my car had been auctioned for $1,200 that morning. Blue book ~$8,000.00

Well this sounds interesting and bad at the same time...

First of all I want to say that the letter that you received, was it a certified letter where you had to sign for it ?
As a general rule all letters sent out regarding pending lien sales are sent certified, which meets the requirement of notification of owners of the vehicles..

Yes the state law says 15 days, but at times DMV takes a bit of time to provide the information and then lets not forget the "speed" of the US Post Office... Add in a weekend or a holiday and you can easily get past the 15 days...

Now I have to question the part where you where home and you attempted to contact them. I am assuming that you meant by telephone...  Personally I would of went down there and done what I had to do to get the vehicle out or to stop the charges...

Going back out of town, without handling this problem does not seem good to me or really show interest in handling the issue. But that is beside the point here.


What to do, well it sounds like the vehicle was handled correctly and the mailing is the only issue that can be possible to use to get something back... But since it is sold, the courts would be the only one who has the power to get the issue resolved...

But it does sound to me that you have lost the vehicle.
