Towing Issues: wrongful tow, tow truck driver, small claims court


Question
I parked my car in my parking pad, two doors down from an apartment bldg.  
A tow truck driver took my car and broke a linkage in the process.  His
superintendent came out and confirmed he should not have taken my car - I
took pictures of the tow truck marks.  

They are only willing to pay some of my rental car charges, and want to take
the car to their mechanic to fix it.  Since they basically trespassed, shouldn't
they pay for all the rental charges and use a mechanic I authorize.  What can I
threaten them with if they don't (and reasonably hope to follow through with).

Well it generally is up to the tow company owner and the policies regarding damages done when towing vehicles.   

But as in any business, they do the same thing. They try to minimize the expenses and while you may want to use a specific mechanic, most tow companies would refer or take the vehicle to one of the companies they do the towing for... Kind of a you scratch my back deal...

There is nothing wrong with this as long as it is done right and correctly..

As to the rental expenses, well I really  have no solid answers on that as it is just one of those things you have to work out with them.

Lots of issues here and I do not think that threating will be a good idea as remember you are kind of at their mercy to get the vehicle repaired unless you want to have it repaired your self and pay for it. Then you can always use the small claims court to settle the issue.
