Towing Issues: vehicle towing, question works, davenport iowa

Last night, my daughter car was towed from a public street. The towing company said it was blocking a driveway and the owner of the vehicle in the driveway asked that it be towed. This is not the owner of the property, just a tenant of an apartment building. The person in question works for the towing company that towed the car. They did not notify the police until after they had towed the car and my daughter had reported it stolen. My daughter, her boyfriend and the people whom she was visiting said she was not blocking the driveway. I live in Davenport, Iowa and my question is, Is it legal to tow a car without notifying the owner and without consent of the property owner? In other word, if I lived in a apartment house and wanted to have a vehicle towed from partially blocking the driveway, would the landlord have to give permission or be present?

Something in this does not pass the smell test...

First of all, if I understand it right the vehicle was parked on a public street and it was towed for blocking a driveway...
A person who lives there called and had it towed... Even though he worked for the tow company...

OK, my thoughts are that this is not legal... First of all a private person ordering a tow from a "PUBLIC STREET" does not sound legal and in most areas it is illegal... The police have the power and legal authority to have vehicles removed from public streets..

Now if the vehicle is parked on private property then the property owner / manager has the rights to have it removed after signing an authorization to impound...

I would suggest that you contact the police again and see if there are local rules which I do not know about or can not find...  But it does sound like they did break a few laws (at least to me)
