Auto Insurance Claims: Claim Time, insurance expert, claims advice

I live in tennessee, and back in jan. my wife's car was damaged by a motorist who backed into her at a gas station since then we have been through a lot with our marriage, the death of her mother and a big move and haven't had the chance to file a claim with the motorists insurance its now 6 months later. Can we still file that claim, or is there a time limit to file damage claims?

 Hello Robert,

Yes you can still file a claim 6 months later, but it will be more of a challenge than had you done so originally.  Hopefully your wife filed a police report to document the event.  That would make things much easier for you as it establishes what occurred.  If not, it could be an uphill battle, especially if the at fault driver decides not to cooperate or not to corroborate the accident.

You are going to need to offer some type of proof that this accident occurred.  Hopefully you can do that.  

In the alternative, you could file through your own Collision insurance if you have it.  That would pay for your damages regardless of fault.  Again, however, you would need to establish the details of the accident providing, at least, information on the other driver.  You would, of course, have to pay your deductible.  However, if your insurance company could establish that the other driver was at fault, they could subrogate the at fault carrier for what they paid along with a refund of your deductible.
