Auto Insurance Claims: Not happy need help, gravel plant, road gravel

I have a quick question about an accident i was recently in if you could help. I was driving in my town around 1 am dry road conditions going about 55-58 KM when the limit was 60KM and something possibly a dog or coyote( Size of a larger farm dog) ran in front of my vehicle. Recently taking a defensive driving coarse for work I knew that you steer towards the animals rear end because it will be moving away and possibly not be there I made it around the animal without hitting it and then went to correct my car straightening it on the road. As I did the rear of my car pulled through due to the gravel on the road( gravel plant located within 20meters) at that time my car hit the median and a sign on the median causing damage to my car. My insurance company has put me 100% at fault but I thought that animal involved accidents are no fault. I have a witness in the car but due to not hitting the animal no blood on car or carcus. What are my options I lose 6 demerites off my license for this and I don't believe that is fair because I did everything to the best of my abilities.

Hi Joseph,

Unfortunately, you would have been better off to hit the dog. Without proof of an animal hit an insurance company will always consider you to be at fault. The witness in your car does not count because they assume that a friend or relative would be willing to lie for you. There is nothing you can do in this case.
