Tips on Buying Cars: Recind auto purchase in florida., florida department of transportation, arbitration clause

Question
I purchased a new vehicle where it was revealed upfront all costs.(Initially the vehicle I planned to trade in was given 3K and the interest rate was 7.3%)  The only thing that was added on when I got in with the finance guy was the tag purchase.  I did not take possession because I did not have Title with me and had to go out of town for two weeks.  When I returned, I changed vehicles for the trade. This vehicle was only given $500 value so the dealership claimed that they only modified the price for the difference in Trade.  At signing with the finance guy, the interest rate was 7.39.  I refused.  They called me and claimed good news!  They lowered the rate to 6.39. However when I went in this time they also added $499 in Dealer fees.  I mentioned this to the sales guy and he claims everyone pays this.  Well that cost was not added on previously.   I feel cheated because the price of the vehicle;  with all costs; had been created to get me to purchase it. I did not realize that they had zipped me until I reviewed my papers several times.  I ended up paying the manufacturer retail price and then whatever additional cost after that. Can I return the car?  I am in Florida.  I do not see anything inthe agreement that states I can cancell/recind.  Only abritation.

Answer
Joy,

Unfortunately there isn't anything that you can do.  The arbitration clause is between you and the lender, not the dealership.  There isn't anything that you can do.  Well, you get a lawyer and go from there, but it would be a waist of your money, if the lawyer even took the case.  I know you do not want to hear this, but you should not have signed the contract until you reviewed all of the figures and agreed that everything was correct.

I wish that I could give you more good news.  Now, what you can do is file a complaint withe the Florida Department of Transportation, and with the BBB in your area, or the area where you bought the car.  That will get the attention of the dealership, and just maybe they will find a way to make you happy.

Hope this helped a little.

Thanks - JB
